LYON COUNTY BOARD OF COMMISSIONERS LYON COUNTY GOVERNMENT CENTER, MARSHALL, MN

COUNTY AND JUDICIAL DITCH PUBLIC HEARING

August 19, 2008

1:30 P.M. - Meeting called to order by Vice-Chairman Ritter. Members present:

Fenske, Ritter, Nelson, Stensrud, and Auditor /Treasurer Van Overbeke.

Absent: Chairman Goodenow, Administrator Stomberg, Attorney Maes.

Pledge of Allegiance to the Flag

1:35 P.M. Goodenow arrived.

Nelson moved, seconded by Fenske to assess CD 4 13% of benefits. All voted in favor.

Hammer - This is in Lucas township. Fenske moved, seconded by Ritter to assess 7% for CD 5. All voted in favor.

Stensrud moved, seconded by Ritter to close county ditch 7 and move funds to county ditch 7 improvement account. All voted in favor.

Stensrud moved, seconded by Ritter to assess CD 7 3%. All voted in favor.

Nelson moved, seconded by Ritter to assess 20% for CD 12. All voted in favor.

Ritter moved, seconded by Nelson to assess CD 13 10% which is $3,519.27. All voted in favor.

Stensrud moved, seconded by Fenske to assess CD 15 10%. All voted in favor.

Nelson moved, seconded by Fenske to assess CD 17 20% or $2,327. All voted in favor.

Ritter moved, seconded by Stensrud to assess CD 18 3% or $15,719.11. All voted in favor.

Fenske moved, seconded by Nelson to collect 20% for CD 19 & CD 35. Don Wambeck - From 23 west that ditch is always full of cat tails. It has to be cleaned quite frequently it seems like. When you get down to the Redwood River they dug the ditch deeper then the river. Hammer - We have used the spray program to kill cat tails and we have hired a company to come in and do it. It is about $0.25 a foot to have it sprayed and about $1.00 to have it cleaned. You have to spray them in the fall. It is a product similar to roundup. Fenske - Do you clean it out afterwards or do they take care of themselves? Goodenow - The point when you do the cleanup is not just to get the cat tails out of there is it. Hammer - This portion of 19 & 25 is pretty flat. I saw no crop loss because of the water not being able to get away. Wambeck - How often do you have to spray for those cat tails every year then? Hammer - About every 6 years. Stensrud - It may be cheaper. Wambeck - Will they eventually die off? Hammer - Yes they do. All voted in favor.

Ritter moved, seconded by Stensrud to assess CD 32 20% for a total of $4,458. All voted in favor.

Stensrud moved, seconded by Rtiter to assess CD 34 8% for a total of $26,338.32. All voted in favor.

Ritter moved, seconded by Nelson to assess CD 37 Repair B 20% or $8,607.60. All voted in favor.

Fenske moved, seconded by Ritter to assess CD 39 15% of the benefits. All voted in favor.

Stensrud moved, seconded by Nelson to assess CD 48 5%. All voted in favor.

Ritter moved, seconded by Stensrud to assess CD 56 redetermination 7% or $26,138.42. All voted in favor.

Nelson moved, seconded by Ritter for CD 60B to be assessed 5% for $41,992.15. All voted in favor.

Fenske moved, seconded by Ritter to collect 20% of the benefits for CD 68. All voted in favor.

Stensrud moved, seconded by Ritter to assess County Ditch 69 5% of the benefits. All voted in favor.

Ritter moved, seconded by Nelson to assess County Ditch 70 15% or $25,622.70. All voted in favor.

2:32 p.m. Goodenow closed the public hearing for county ditches.

2:32 p.m. Goodenow opened a public hearing for judicial ditches.

Ritter moved, seconded by Fenske for JD 7B to be assessed 20% of the benefits or $3,712.80.

Voting in favor: Ritter, Fenske, Goodenow, Nelson

Voting Against: Stensrud.

Motion carried 4 to 1.

Fenske moved, seconded by Ritter to close Judicial Ditch 9 and move the funds to Judicial Ditch 9 A & B. All voted in favor.

Ritter moved, seconded by Stensrud to assess 4 % of the benefits for $14,021.81. VanOverbeke - What is the estimate of the repair being done now? Hammer - About $4,500. All voted in favor.

Ritter moved, seconded by Nelson to assess JD 12 12% of the benefits or $8,373.60. All voted in favor.

Stensrud moved, seconded by Ritter to assess JD 14 Redwood Lyon County 20% or $293.20. All voted in favor.

Ritter moved, seconded by Stensrud to assess JD 18 10% or $11,348.50. All voted in favor.

Stensrud moved, seconded by Ritter to assess JD 20 Lyon, Murray, and Redwood 4%. All voted in favor.

Fenske moved, seconded by Ritter for the JD 15 R & L deficit to be moved to number 939. All voted in favor. Goodenow - The 938? The loan isnt on there? Discussion. All voted in favor.

Ritter moved, seconded by Stensrud to assess JD 37 of R & L 10% which would be $1,258.85. All voted in favor.

3:00 p.m. Goodenow closed the Judicial Ditches public hearing.

3:28 p.m. Nelson moved, seconded by Fenske to adjourn. All voted in favor.
