NOTICE OF HEARING FOR VARIANCE ADJUSTMENT PERMIT
Archer Daniels Midland Company (ADM), has filed an application for a Variance Adjustment Permit to construct a 132 feet high elevator in an I-2 District in lieu of 75 feet as required by City ordinance. The legal description of the property is:
That portion of the S 1/2 SW 1/4 of Section 33, Township 112 North, Range 41 West of the 5th P.M., Lyon County, Minnesota, being a portion of the same property described in Warranty Deed dated February 28, 1947 from Donald Blanchette, et ux to Great Northern Railway Company described as follows, to-wit:
Beginning at the point of intersection of South line of said Section 33 with the Westerly right of way line of 7th Street in the City of Marshall, Minnesota, said point being 272.80 feet East of The Burlington Northern and Santa Fe Railway Company's (formerly Great Northern Railway Company) Main Track Centerline, as now located and constructed; thence Northeasterly along said Westerly right of way line at an angle of 67 degree 13 feet with said South section line a distance of 107.7 feet; thence turning an angle of 23 degree 49 feet to the right and running along the Westerly right of way line of 7th Street a distance of 430.0 feet; thence Northwesterly, leaving said Westerly right of way line, along a line at right angles to said Main Track centerline a distance of 175 feet, more or less, to a point 250.0 feet Southeasterly, as measured at right angles from said Main Track centerline; thence Northeasterly parallel with said Main Track centerline 210.0 feet; thence Northwesterly at right angles to said Main Track centerline 210 feet, more or less, to the intersection with a line drawn parallel with a distant 8.5 feet normally distant Southeasterly from said Railway Company's most Easterly Elevator Track centerline, as now located and constructed; thence Southwesterly along the last described parallel line 790 feet, more or less, to the South line of said Section 33; thence East along said South line to the Point of Beginning.
That part of the Northwest Quarter (NW 1/4) of Section Thirty-three (33), Township One hundred Twelve (112) North, Range Forty-one (41) West, being a 50.00 foot strip of land adjacent and parallel to the Right of Way line of the Burlington Northern Railroad described as follows:
Commencing at the point of intersection of the South line of said NW 1/4 of Section 33, with the center line of the main track of the Burlington Northern Railway as it is now located; thence North 89 degree 59 feet 57 inches East along the South line of said NW 1/4 of Section 33 for a distance of 53.15 feet to the Right of Way line of said Burlington Northern Railroad and the point of being the point of beginning; thence North 19 degree 56 feet 28 inches East along the Easterly Right of Way of the Burlington Northern Railroad for a distance of 761.4 feet to the Southwesterly boundary of 50.0 foot wide strip of extra railroad right of way as described in Lyon County Register of Deeds, Book M-Deeds, page 375-376; thence South 70 degree 3 feet 32 inches East for a distance of 50.00 feet; thence South 19 degree 56 feet 28 inches West for a distance of 743.3 feet to the South line of the NW of said Section 33; thence South 89 degree 59 feet 57 inches West 53.15 feet to the point of beginning. Containing 0.86 acres more or less. Subject to highways and easements of record.
