NOTICE OF HEARING ON PRELIMINARY PLAT

Copies of a Preliminary Plat have been filed with the City by Lockwood Motors, LLC for Lockwood Addition.

The tract of land involving the area of the Preliminary Plat is described as follows, to-wit:

LAND DESPRIPTION

All that part of Lot 2, Block 1 of McFarland Addition and Outlot A of Har-Mar Foods Addition, all in the City of Marshall, as filed and recorded in the office of the County Recorder in and for Lyon County, Minnesota, being more particularly described as follows:

Commencing at the southwest corner of Lot 1, Block 1 of said McFarland Addition; thence South 00 degrees 35 minutes 02 seconds, bearing based on Lyon County Coordinate System, along the west line of the Southeast Quarter of Section 3, Township 111 North, Range 41 West, a distance of 20.00 feet, to a corner of said Lot 2, said point also being the point of beginning; thence North 89 degrees 49 minutes 40 degrees East a distance of 150.00 feet, to a corner of said Lot 2; thence South 00 degrees 35 minutes 02 seconds East a distance of 44.35 feet, to a point on the south line of said Outlot A; thence South 89 degrees 50 minutes 14 seconds West, along said south line, a distance of 150.00 feet, to the southwest corner of said Outlot A; thence North 00 degrees 35 minutes 02 seconds West, along the west line of said Southeast Quarter, to the point of beginning.

AND THE FOLLOWING RECORDED LAND DESCRIPTIONS

Lot One (1) in Block One (1) of McFarland Addition to the City of Marshall, according to the recorded plat thereof,

AND

All that part of the North Half of the Southeast Quarter (N1/2SE1/4) of Section Three (3), Township One Hundred Eleven (111) Range Forty-one (41) West of the Fifth Principal Meridian, described as follows:

Beginning at the Southwest corner of said Lot 1 in Block 1 of McFarland Addition to the City of Marshall, and running thence Southerly on the west line of siad N1/2SE1/4 of Section 3, a distance of 20 feet; thence Easterly and parallel with the south line of said Lot 1, Block 1, McFarland Addition, a distance of 150 feet; thence Northerly and parallel with the West line of said N1/2SE1/4 of Section 3, a distance of 20 feet; thence Westerly on the South line of said Lot 1, a distance of 150 feet to the place of beginning.

AND

All that part of the NE1/4SW1/4, Sec. 3, Twp. 111N, Rge. 41W, Lyon County, Minnesota, described as follows, to-wit: Beginning at a point 33 feet South of the NE corner of the NE1/4SW1/4 designated as the South line of Trunk Highway 19, and running thence South along the East line of the NE1/4SW1/4, a distance of 491 feet; thence West at right angles a distance of 296 feet; thence North at right angles, a distance of 491 feet to the South line of Trunk Highway 19; thence East at right angles, along the South line of Trunk Highway 19, a distance of 296 feet to the point of beginning.

AND

All that part of the Northeast Quarter of the Southwest Quarter (NE1/4 SW1/4) of Section Three (3), Township One Hundred Eleven (111), Range Forty-one (41), described as follows:

Commencing at a point four hundred forth-six (446) feet west and three hundred fifty (350) feet south of the northeast corner of the Northeast Quarter of the Southwest Quarter (NE1/4 SW1/4), thence run south on a continuation of said line 174 feet; thence run east at right angles to last line 150 feet; thence run north at right angles to last line 174 feet; thence run west at right angles to last line 150 feet to the point of beginning, subject to highways and easements of record.

PLEASE TAKE NOTICE that a Public Hearing will be held to consider approval of said Preliminary Plat before the Marshall City Council in the Professional Development Room of the Marshall Middle School located at 401 South Saratoga Street at 5:30 P.M. on Tuesday, August 7, 2012.

At such hearing, the City Council shall review the plat, consider all oral and written reports, comments and recommendations and determine as to whether or not to approve the plat.
