Tracy teacher pleads not guilty to charges

MARSHALL — A Tracy teacher facing charges for allegedly pushing a student appeared in Lyon County District Court on Tuesday, court records said. Richard William Haberman, 53, pleaded not guilty to charges of malicious punishment of a child and fifth degree assault.

A criminal complaint alleges that in March, Haberman grabbed a student and pushed him up against a wall during gym class at Tracy Elementary School.

Tracy Superintendent Chad Anderson said the school district was aware of the incident, and had conducted its own investigation. Haberman was suspended for two days without pay as a result of the incident, Anderson said.

At Tuesday’s hearing, Haberman’s attorney requested a trial date. A date for a one-day jury trial was set for Nov. 2, with an Oct. 24 pre-trial hearing, court records said. An additional hearing date was set for Oct. 10.
