AG’s Office moves for mistrial in Broadmoor case

MARSHALL — Attorneys from the Minnesota Attorney General’s Office have moved for a mistrial in the lawsuit against the owners of the Broadmoor Valley mobile home park.

This morning, proceedings in the civil trial started out with state attorneys arguing that some of the testimony heard over the past two days would unfairly influence the jury. In particular, attorneys said that jurors had learned that Residents United, a residents’ association at Broadmoor Valley, had already unsuccessfully sued the Broadmoor Valley owners in the past. Some of the witnesses questioned over the past two days had also said they testified for the Residents United lawsuit.

Attorney Alex Baldwin said the jury would be “permanently prejudiced” by hearing that information.

Attorneys representing Schierholz and Associates and Paul Schierholz urged the District Court judge to reject the motion.

Judge Tricia Zimmer said she would take time to consider the motion, and come back with a written response later Friday morning.
