PUC rescinds Magellan pipeline permit

The Minnesota Public Utilities Commission has reversed its decision to grant a permit to reroute a petroleum pipeline near the Pipestone National Monument.

This week, the PUC said it would require Magellan Pipeline Co. to do additional analysis and engage with tribal nations.

Magellan was seeking to reroute a stretch of pipeline that was shut down by the federal government in 2022 to protect the monument. Area tribal representatives voiced opposition to the re-route. At a September PUC meeting, tribal representatives said the Pipestone National Monument and pipestone quarries in the area are both sacred and culturally important.

The reroute the PUC initially approved was about 13.1 miles long, and went further away from the monument than Magellan Pipeline Co. wanted. The 13-mile reroute was one that was suggested by the Mille Lacs Band of Ojibwe.

In a Tuesday news release, the PUC said it was rescinding the route permit, and would require Magellan to complete “cultural, archaeological, and historical resources inventories” for two proposed pipeline routes before they would consider it further. The PUC said their decision included coordination with 15 tribal nations and entities with ties to the pipestone quarries.

The PUC said Magellan will need to file a compliance document after doing the inventories, and allow tribes to view the findings. The filing must include any feedback Magellan received, and a certification that they have coordinated with or tried to coordinate with tribal nations and communities.
