Testimony begins in Broadmoor Valley trial

A civil trial in a lawsuit against the owners of the Broadmoor Valley mobile home park in Marshall is underway in Lyon County District Court. On Wednesday, jurors heard testimony from witnesses including a Broadmoor Valley resident and an inspector with Southwest Health and Human Services.

MARSHALL — The civil trial in a lawsuit against the owners of the Broadmoor Valley mobile home park wrapped up its second day in Lyon County District Court on Wednesday. Jurors heard witness testimony from a resident of Broadmoor Valley, and a member of the agency that inspects mobile home parks in Lyon County.

In their testimony, Broadmoor Valley resident Debra Springer-Ertl and Jason Kloss, environmental health manager of Southwest Health and Human Services, both answered questions about the condition of the roads and other infrastructure in the mobile home park. During part of her testimony, Springer-Ertl and the jury were shown photos Springer-Ertl took of puddles and bumps on the roads at Broadmoor Valley. Springer-Ertl said the photos were taken at different times within the past six years.

Kloss also answered questions about standing water and deteriorating road surfaces at Broadmoor Valley. Those conditions were noted in park inspection and followup reports dating from 2018 up through 2024. Issues like standing water on the roads, potholes, and leaks in the park’s storm shelter repeatedly showed up in the reports presented to the jury.

At the close of Wednesday’s court proceedings, District Court Judge Tricia Zimmer said the trial would continue today, starting with more testimony from Kloss.

The Minnesota Attorney General’s Office sued Broadmoor Valley owners Schierholz and Associates and Paul Schierholz in 2021. The Attorney General’s Office alleged the owners failed to maintain Broadmoor Valley and its streets to state standards. The lawsuit also alleged the owners charged illegally high fees for late rent payments, and retaliated against residents of the park.
