Marshall City Council approves duplex permit
MARSHALL — Marshall City Council members approved a permit request for a residence on Carrow Circle to be used as a duplex.
City staff told council members Tuesday that the home has already been used as a duplex recently.
Agenda packet materials at Tuesday’s council meeting said the home, located on Carrow Circle, was built in 1976 as a single-family residence. Today it stands in a low-density residential area. In recent years the home has been used as a duplex, and that use requires a conditional use permit.
Assistant Planning and Zoning Administrator Ilya Gutman said the issue came up when the property owners applied to the city for a rental registration.
“Now in order to give them a rental registration, they need to bring it back into compliance with the ordinance, meaning they have to have a conditional use permit,” Gutman said.
Gutman said that while the duplex is in a low-density residential area, it’s not far away from areas of higher-density housing. “So it’s not a unique place here,” he said.
The Marshall planning commission conducted a hearing on the matter on Feb. 12. Commission members unanimously voted to recommend approval of the permit.
“There were no concerns from the public” at the hearing, said council member Amanda Schroeder.
Council member James Lozinski said the city’s response to the permit request put a positive light on Marshall’s rental registration ordinance.
“I think this shows that we as a council and as a city, as you apply for these rental ordinances — we’re not trying to shut your business down,” Lozinski said. “This is a good example. Our city uses common sense,” he said.
